Terms and Conditions of on-line prize contest »Pino«

Article 1: ORGANIZER

The organizer of the "Pino" prize draw (hereinafter: contest) is Turistično združenje Portorož (Portorož Tourism Board) g.i.z., Obala 16, 6320 Portorož (hereinafter: organizer).

The organizer runs the prize contest in partnership with the co-organizer April 8, digitalna agencija d.o.o, Šmartinska cesta 152, 1000 Ljubljana (hereinafter: co-organizer). They organise the draw and announce the winners.  

Article 2: AIM

The purpose of the contest is to promote new tourist offers – experience packages. 

Article 3: TERMS, CONDITIONS AND METHOD OF PARTICIPATION

Participation in the prize contest is free. Participants must be a natural person as defined by law. Companies, organisations or sole traders are not eligible to participate. By participating in this contest, participants agree to, and abide by, the Terms and Conditions for this contest.

Participation in the prize sweepstake is possible from July 28th, 2020 until midnight of December 10th, 2020 via Facebook Messenger https://www.facebook.com/MyFriendPino/. Users who participate in the prize sweepstake after the end of the above mentioned period will not be included in the prize draw.

Participation in the contest is open to all natural persons who correctly answer a question on the aforementioned link in Facebook Messenger, and enter the required data in the appropriate form, which is then successfully submitted. Only submissions containing all required data are deemed participating entries.

These Terms and Conditions do not specify that a participant must be a resident of a European Union country. Non-residents are also eligible to participate in the contest.

Limitations:

- The organizer, co-organizer, their employees, external contractors, business partners and/or their

   family members are not eligible to participate in this contest.

Article 4: WITHDRAWAL FROM PARTICIPATION

Participants can withdraw their participation from the contest at any time by sending a message via e-mail to: info@portoroz.si. The withdrawal is complete once the message is received. The participant will then no longer be eligible to participate in the draw.

Article 5: THE DRAW AND WINNER ANNOUNCEMENT

Among all those who will meet the conditions to participate in the prize sweepstake (defined in Article 3), 15 winners will be drawn (3 winners each month) that will receive the prize defined in Article 7 of these Rules.

The draw of the winners will be performed electronically once a month during the prize sweepstake duration. The winners with their e-mail addresses will be published on info@portoroz.si website within 7 days. All participants will be informed about the outcome of the draw via e-mail with an invitation to view the list of winners on info@portoroz.si website.

The draw will be conducted on a computer, using a random algorithm software with the participant’s data written in. The draw will be overseen by a supervising commission, ensuring the draw is fair and meets all the criteria as stated in these Terms and Conditions. The president of the commission will prepare a report containing the list of draw winners. The report must be approved and signed by all members of the commission. The report will be saved and kept for one year, at the co-organizer’s address.


Monthly draw dates:

  • Monthly draw 1: August 17th, 2020
  • Monthly draw 2: September 15th, 2020
  • Monthly draw 3: October 15th, 2020
  • Monthly draw 4: November 16th, 2020
  • Monthly draw 5: December 11th, 2020


All contest winners expressly authorize the publication of their names, surnames and photographs on the organizer's website, Facebook page or on any other media and social networks, for which they will not demand any payment or compensation from the organizer. Winners also waive their right to review, approve, oppose any use of the aforementioned material, editorial choices or their appearance.

Article 6: SUPERVISING COMMISSION

The supervising commission consists of 3 members. These are:

  • Petra Rebec (Portorož Tourism Board g.i.z.) - president of the commission
  • Fredi Fontanot (Portorož Tourism Board g.i.z..) - member
  • Lara Burkat (April 8 d.o.o.) – member of the Commission

Article 7: PRIZES

The partecipants in the prize sweepstake take part in weekly prize draws for:

  • 15 x 1 selected experience worth up to € 42


Article 8: COLLECTION OF PRIZES

In order to receive the prize, the winner, at the written invitation of the organizer, must submit the following personal data via e-mail: name, surname and address. For the purpose of informing about the receipt of the prize, the winner also provides a contact telephone number.

If the winner doesn’t provide all the necessary information within 8 (eight) days from the receipt of the written request, they lose the right to receive the prize and will not be entitled to any compensation. In this case, the organizer is free of all obligations towards the prize winner and the prize remains unawarded.

The winners receive the prize in the form of a gift certificate, to the address the provided, within 15 (fifteen) days after all the required information has been received.

If the winning participant is under the age of 18 (eighteen), they must obtain and provide written consent from their parents, or legal guardians, when submitting their personal information. Only then can they claim the prize.

If a winner declines the prize, it is considered that they do not wish to receive it, and thus the organizer is free of all obligations in relation to such winner in regards to this prize draw. In such circumstance, the organizer acquires the right to keep the prize and use it for whatever purpose they deem appropriate.

Prizes cannot be exchanged for, or paid out, in cash. The right to the prize cannot be transferred to a third party. The results are final and appeals are not possible. 

Article 9: REPORTING PRIZE INFORMATION TO THE TAX AUTHORITY

If the value of the main prize exceeds €42 (forty-two Euro), the winner is obliged to provide personal data (copy of an identity card, telephone number, as well as their tax number and their tax office information).

If the personal data is inaccurate, it is considered that the winner declined the prize.

Personal income tax for the received prize must be paid by the payer – in this case the organizer of this prize draw. The organizer will calculate, pay and deduct from the prize any personal income tax in advance, in accordance with current laws and regulations.

If the winner is not a resident of the Republic of Slovenia, income taxation is subject to the rules of international agreements on avoidance of double income taxation. In this case, the winner will have to regulate the payment of the tax by themselves.

All other expenses and charges associated with the prize (e.g. additional income taxation) are borne by the winner.

Article 10: BINDING TERMS AND CONDITIONS

These Terms and Conditions are binding and apply to the organizer and other parties, who are in any way connected with organising, running and issuing of prizes connected to this contest. These terms and conditions also apply to all participants who, by taking part in this contest, accept the draw’s rules and undertake to respect them. The Terms and Conditions of this contest are available online, in full, on www.portoroz.si in full, for the duration of the contest. The commission, which appoints and authorizes the organizer’s legal service regarding individual opinions and other legal tasks, is responsible for the interpretation of individual articles of these Terms and Conditions.

In the event of serious violations of these Terms and Conditions, the commission may terminate the contest in its entirety and re-organise the contest with appropriate corrections applied.

Article 11: EXCLUSION FROM THE CONTEST

In the event a participant violates these Terms and Conditions, the organizer reserves the right to exclude the participant from the draw without prior notice. Participants who use illegal devices (e.g. hacker tools, viruses, Trojans, etc.), fake e-mail addresses, or otherwise gain benefits through manipulation, will be excluded. A person taking part on behalf of third parties (with or without their knowledge) can also be excluded from the prize contest. Participation through, via or on behalf of other groups, organisations or societies, automatic services or through prize contest professional services is not allowed.

In the event of exclusion from participation in this prize contest, the winning entry will be declared void and null and no prize will be awarded to that participant. If the irregularities are discovered after the prize has already been collected, the organiser may demand that the winning participant returns the prize in its original form or pays the monetary compensation for damages incurred.   

Article 12: EXCLUSION OF LIABILITY

The organizer is not liable for any direct or indirect damage that results from participation in this contest or if the server is unavailable, unless the organizer causes the damage intentionally, due to severe negligence on its part, or by breaching its contractual obligations. The organizer is not responsible for any technical errors, including network, electronics or computer failure. 

Article 13: EARLY TERMINATION OF THE CONTEST

The organizer reserves the right to cancel or terminate the contest at any time without prior notice, warnings and/or without explanation.  The organizer will apply this option particularly in case of failure of technology (e.g. viruses in the computer system, manipulations/hacking, or hardware and/or software malfunctions) or for legal reasons where the contest cannot be run fairly and/or under the established rules. In case the prize draw is interrupted because of a participant’s violation, the organizer may request compensation from the participant who caused the damage.

Article 14: CONFIDENTIALITY, PROTECTION AND USE OF PERSONAL DATA

The organizer and co-organizer will carefully protect personal data in accordance with the Personal Data Protection Act (ZVOP-1) (Official Gazette of the Republic of Slovenia, No. 94/2007-UPB1), the Electronic Communications Act (ZEKom) (Official Gazette of the Republic of Slovenia, No. 3/2007-UPB1, 110/2009) and the General Data Protection Regulation (hereinafter GDPR).

According to the GDPR, the personal data controller may process personal data if they obtain an individuals’ personal consent, i.e. a voluntary statement where the user declares that their personal data may be processed for a specific purpose. Participants give their consent during their registration to the contest by pressing the SEND button, and by agreeing to the General Terms and Conditions of the contest.

The general conditions of the prize sweepstake also include the following statement: "I allow Turistično združenje Portorož to use my personal data for the purposes of conducting this prize sweepstake"

I can withdraw my consent for processing personal data at any time by sending a written request by e-mail to info@portoroz.si or by post to Turistično združenje Portorož (Portorož Tourism Board), g.i.z., Obala 16, 6320 Portorož. 

The organizer, in its capacity as a personal data controller, will use the participants’ personal data exclusively for the following purposes:

- for the process of running this prize contest (all aspects),

- to inform the winning participants of the results and prize collection,

- to publish the names of winners on its website.

The organizer processes gathered personal data in accordance with the legislation in force in the field of personal data protection and allows access to such information only to those employees who have committed themselves to the relevant confidentiality obligations.

The organizer will not, in any instance, transfer or disclose personal data to third parties.

All data will be stored in the database of Portorož Tourism Board and/or with personal data contractual processors in accordance with the legal deadline, or until a participant withdraws their consent to the storage of their personal data.

The organizer will not transfer or process personal data outside the European Economic Area (EEA) without compliance with the Standard Data Protection Terms of Reference (or other similar Regulations which may be adopted over time by the European Commission).

The winners’ tax numbers and tax office info data are kept for 5 (five) years from the prize award or for as long as it is required by tax legislation.

The participant acknowledges that:

- they can request access to their personal data,

- they can request their data be amended in case of any errors or changes of circumstances,

- they can request the erasure of their personal data (right to be forgotten) if the assumptions of Article 17 of the GDPR are fulfilled, in particular in the case of withdrawal of consent given for their personal data processing for the purposes of this prize contest,

- they can request their personal data processing be restricted,

- they can request the transfer of personal data in a structured, commonly used and machine-readable form without incurring a fee,

- they can lodge a complaint with the supervisory authority, if they think that personal datprocessing violates the General Data Protection Regulation,

- they can apply for the exercise of the rights referred to in the preceding paragraph or obtain additional information concerning personal data processing and protection with an authorized data protection person via e-mail, on petra@portoroz.si or at the address of Portorož Tourism Board, g.i.z., Obala 16, 6320 Portorož,

- they can file a complaint against personal data processing that does not comply with this prize contest’s General Terms and Conditions with the Information Commissioner of the Republic of Slovenia.


Article 15: MODIFICATION OF TERMS AND CONDITIONS

The contest organizer, Portorož Tourism Board, g.i.z., Obala 16, 6320 Portorož, reserves the right to change the prize contest’s Terms and Conditions at any time in case of content, commercial or technical reasons.

The organizer will keep participants informed about all changes and novelties with publications on the prize contest’s website.

Article 16: OTHER TERMS AND CONDITIONS

Employees of Portorož Tourism Board, g.i.z.  and their immediate family members, as well as other natural or legal persons involved in any way in this prize contest, are not eligible to participate.

Terms and Conditions are binding for the organizer, all employees and other persons who are in any way connected with this prize contest and prize draw, who are the subject of these Terms and Conditions; and for all participants in the prize contest who agree with these regulations which they have confirmed upon registration.

These Terms and Conditions are available, in full, online at www.portoroz.si. 

Article 18: CLAIMS, COMPLAINTS AND GRIEVANCES

All claims, complaints and/or grievances regarding the running of this prize contest are to be resolved by the organizer. The organizer commits themselves to resolve all valid issues in the shortest time possible. All relevant participants will be notified.

All unresolved disputes arising in connection with the prize contest and draw, will be resolved under the jurisdiction of the relevant court in Koper.

Article 19: FINAL TERMS AND CONDITIONS

The organizer undertakes to do everything in its power to run this contest correctly. Liability does not include cases of force majeure. In the event of circumstances that cannot be influenced by the organizer (force majeure, logistical obstacles, technical problems), the organizer can terminate this contest and must inform all participants. In such a case, it is not liable to the participants for any incurred damages. The organizer’s decision on all questions concerning this contest or the use of its Terms and Conditions is final and valid for all participants.

Article 20: VALIDITY OF TERMS AND CONDITIONS


The rules enter into force on July 27 th, 2020.
