Terms and Conditions of the online prize contest "Build a goat!"

ARTICLE 1: ORGANISER

Organiser of the "Build a goat!" contest (hereinafter referred to as prize contest) is Turistično združenje Portorož (Tourist Board Portorož) , g.i.z., Obala 16, 6320 Portorož (hereinafter referred to as organiser).

The organiser will run the prize contest and, together with the co-organiser (April 8, digitalna agencija, d.o.o., Šmartinska cesta 152, 1000 Ljubljana), will organise the prize draw and announce the winners.

ARTICLE 2: PURPOSE

The organiser publishes this prize contest to promote the new tourist offer at the destination and to promote the partners at the destination.

ARTICLE 3: MODALITIES AND CONDITIONS OF PARTICIPATION

Participation in this prize contest is not dependent on a purchase. The prize contest is open to natural persons only, legal persons and independent contractors are not eligible. By participating in the prize contest, the participant accepts and agrees to be bound by all the rules set out in these Terms and Conditions.

You can enter the prize contest from 10 May to 5 November 2022 until 24 hours on the website https://www.portoroz.si/en/we-are-here/prize-game. Entries that are received after the prize contest closing date (and time) will not be included in the prize draw.

Restrictions on participation:

Employees and external contractors of the organiser and co-organiser of this prize contest or their immediate family members are not eligible to participate in the prize contest.

ARTICLE 4: WITHDRAWAL OF PARTICIPATION

Participants may withdraw their participation in the prize contest at any time during its duration by sending a message to e-mail address: petra@portoroz.si. Upon receipt of this message, the participant will be excluded from the prize contest.

ARTICLE 5: DRAWING AND ANNOUNCING WINNERS

From among all those who meet the conditions for participation in this prize contest (as defined in Article 3), 8 winners will be drawn (5 winners each month and 3 runners-up at the end of the prize contest), who will receive the prize defined in Article 7 of these Terms and Conditions.

The prize draw will be carried out electronically once a month during the duration of the prize contest and the winners will be published on the website www.portoroz.si within 7 days with their email address. All entrants will be notified of the outcome of the draw by email, with an invitation to view the list of winners on the website www.portoroz.si/en.

The prize draw will be carried out by a computer system using a random algorithm to select the prize winners from the pool of participants. The president of the commission prepares a report containing the list of prize winners. The report shall be approved and signed by all members of the commission. It shall be kept for one year at the address of the co-organiser.

Dates of the monthly draws:

  • 1st monthly draw: 6 June 2022
  • 2nd monthly draw: 7 July 2022
  • 3rd monthly draw: 8 August 2022
  • 4th monthly draw: 9 September 2022
  • 5th monthly draw: 10 October 2022
  • 6th final draw: 11 November 2022. The final draw will include all participants who have entered between 10 May 2022 and to 10 November 2022 and who have not yet been drawn for a prize.


All winners expressly authorise the publication of their name, surname and photographs from the eventual prize draw event on the organiser's website, Facebook pages or any other media and social networks, for which they will not be entitled to any payment or compensation from the organiser. They also waive the right to review, approve or object to any use of the material, editorial choice or appearance of the material.


ARTICLE 6: COMMISSION

The commission for the supervision of the prize draws consists of:

  • Petra Rebec (Tourist Board of Portorož, g.i.z.) - chairperson of the commission
  • Fredi Fontanot (Tourist Board of Portorož, g.i.z.) - member of the commission
  • Lara Burkat (April 8 d.o.o.) - member of the commission

ARTICLE 7: PRIZES

The prize fund is divided into six prize pools.

  • The first prize pool consists of 1 x selected experience worth up to EUR 42 and will be awarded in the first prize draw on 6 June 2022.
  • The second prize pool consists of 1 x selected experience up to a value of EUR 42 to be awarded in a second prize draw on 7 July 2022.
  • The third prize pool consists of 1 x selected experience up to a value of EUR 42 to be awarded in the third prize draw on 8 August 2022.
  • The fourth prize pool consists of 1 x selected experience up to a value of EUR 42 to be awarded in the fourth prize draw on 9 September 2022.
  • The fifth prize pool consists of 1 x selected experience up to a value of EUR 42 to be awarded in the fifth prize draw on 10 October 2022.
  • The sixt prize pool consists of 1 x Weekend Package for 2 persons worth up to EUR 250, 1x 3-course menu at Istrian Bistro & Tapas Bar worth EUR 100 and 1x Panoramic flight by plane over the Bay of Piran from Portorož Aerodrome for 2 persons worth EUR 85 to be awarded in the final prize draw on 11 November 2022.


The prizes are provided by:

  • 1x weekend package at Hotel Histrion, St. Bernardin resort Portorož for 2 persons with half board, unlimited access to the sea water park and saunas with sea view is provided by Sava Hotels & SPA.
  • 1x 3-course menu at Istrian Bistro & Tapas Bar is provided by LifeClass Hotels & SPA.
  • 1x Panoramic flight over Piran Bay from Aerodrom Portorož for 2 persons is provided by Aerodrom Portorož.


The limit is one prize per person. If a participant is drawn more than once, he/she will receive the prize for which he/she was drawn at first.

ARTICLE 8: PRIZE COLLECTION

In order to claim the prize, the winner must provide the following personal details when invited in writing by the organiser via e-mail: first and last name and address (to which he/she wishes to receive the prize). The winner must also provide a contact telephone number for the purposes of notification of claiming the prize.

If the prize winner fails to provide the necessary information within 10 days of the date of the reminder, he/she will forfeit his/her right to the prize without any compensation. In this case, the organiser shall be released from any and all obligations towards the winner and the prize will remain unclaimed.

Winners will receive their prize in the form of a gift voucher at the address provided within 15 days of receipt of all the required information. The voucher is valid for 1 year from the date of issue. Persons under 18 years of age must also provide the organiser with the written consent of their parents or legal guardian in order to claim the prize.

If the winner refuses to accept the prize, he/she is deemed to have opted out of the prize and the organiser is therefore released from any and all obligations in relation to this prize draw. At the same time, the organiser shall acquire the right to dispose of the prize for any other purpose.

Prizes cannot be exchanged or redeemed for cash. The right to claim the prize cannot be transferred to a third party. The results are final and no appeals are possible.

ARTICLE 9: DECLARING THE PRIZE TO THE TAX AUTHORITIES

When the value of the main prize exceeds EUR 42, the winner is obliged to provide personal data (copy of ID, telephone number and his/her tax number and the competent tax office). In the event of inaccuracy of the personal data provided, the winner is deemed to have forfeited the prize.

Advanced payment of income tax on the prize is the responsibility of the prize payer - the organiser of this prize contest. The organiser will calculate and pay the advance income tax on the prize in accordance with the applicable regulations and deduct the value of the income tax from the prize.

If the winner is not a resident of the Republic of Slovenia, the rules of international treaties for the avoidance of double taxation will apply. In this case, the prize winner is responsible for the payment of the tax.

All other costs and charges related to the use (e.g. payment of income tax on advance payment) are borne by the winner.

ARTICLE 10: BINDING TERMS AND CONDITIONS

These Terms and Conditions shall be binding on the organiser and all other persons in any way connected with the conduct of the prize contest and the award of the prize, and on participants who, by participating in this prize contest, acknowledge and agree to be bound by these Terms and Conditions. The Terms and Conditions of this prize contest are available for viewing in their entirety at www.portoroz.si for the duration of the contest. The interpretation of the individual articles of these Terms and Conditions shall be the responsibility of the commission, which shall appoint and authorise the legal department of the organiser to provide individual opinions and other legal advice.

In the event of a serious breach of these Terms and Conditions, the commission may cancel the prize contest in its entirety and re-run it with appropriate corrections.

ARTICLE 11: EXCLUSION FROM THE PRIZE CONTEST

In the event of a breach of the above Terms and Conditions by participants, the organiser reserves the right to exclude such persons from the contest without prior notice. Persons who use illegal tools (e.g. hacker tools, viruses, Trojans, etc.), fake email addresses or otherwise gain benefits through manipulation will be excluded. Persons participating on behalf of third parties (with or without their knowledge) may also be excluded from the prize contest. Participation via gaming associations, automated services and, in particular, prize contest professional services is not permitted.

In the event of exclusion from the prize contest, it is possible to withdraw prizes from the prize-winner or demand back pay-outs or awarded prizes.

ARTICLE 12: DISCLAIMER

The organiser shall not be liable for any direct or indirect damage caused to a participant as a result of participation in this prize contest or in the event of unavailability of the server, unless the organiser has caused the damage intentionally, through gross negligence or through a serious breach of contractual obligations. The organiser shall not be liable for any technical failures, in particular network, electronic or computer failures.

ARTICLE 13: EARLY TERMINATION OF THE PRIZE CONTEST

The organiser reserves the right to cancel or terminate the prize contest at any time without prior notice and without any explanation. The organiser shall make use of this option in particular if, for technical reasons (e.g. viruses in the computer system, manipulation or errors in the hardware and/or software) or for legal reasons the correct running of the contest cannot be guaranteed. In case the prize contest is interrupted because of the participant’s violation, the organiser may claim compensation from the participant responsible for the damage.

ARTICLE 14: CONFIDENTIALITY, PROTECTION AND USE OF PERSONAL DATA

The Organiser and the co-organiser will carefully protect personal data in accordance with the Personal Data Protection Act (ZVOP-1) (Official Gazette of the Republic of Slovenia, No. 94/2007-UPB1), the Electronic Communications Act (Official Gazette of the Republic of Slovenia, No. 13/2007-UPB1, 110/2009) and the General Data Protection Regulation (hereinafter referred to as GDPR).

According to the GDPR, the controller of personal data may process personal data if he obtains a personal individual consent,,i.e. it is a voluntary declaration that his or her personal data may be processed for a specific purpose. The user confirms this by pressing the SUBMIT button and by agreeing to the general Terms and Conditions of the contest.


The prize contest General Terms and Conditions include the following statement:

"I give permission for Turistično združenje Portorož to use my personal data for the purposes of this prize contest."

Participants may withdraw their consent to the processing of their personal data at any time by submitting a written request by e-mail to info@portoroz.si or by post to Turistično združenje Portorož, g.i.z., Obala 16, 6320 Portorož.


The organiser, in its capacity as data controller, will use the personal data of the participants in this prize contest exclusively for the following purposes:

  • to run the prize contest in all its aspects,
  • to inform the winners of draw results and prize award,
  • to publish the winners on the prize contest website.


The organiser processes and protects the personal data collected in accordance with the applicable legislation on the protection of personal data and allows access to it exclusively to employees who have undertaken to comply with the relevant confidentiality obligations. Under no circumstances will the organiser pass on or disclose the personal data collected to third parties.

All data will be stored in the database of the Turistično združenje Portorož and/or with the contracted personal data processors in accordance with the legal deadline or until the participant withdraws the storage of personal data.

The organiser will not transfer or process personal data outside the European Economic Area (EEA) without complying with the Standard Contractual Clauses on Data Protection (or other similar clauses that may eventually be approved by the European Commission).

The tax number and tax office of the prize winners will be kept for 5 years from the prize award or as long as required by tax law.


The participant acknowledges that:

  • he/she may request access to his/her personal data,
  • he/she may request the correction of inaccurate personal data,
  • he/she may request the erasure of personal data (right to be forgotten), provided that the conditions set out in Article 17 of the GDPR are met, and in particular in the event of revocation of the consent obtained for the processing of personal data for the purposes of this prize contest,
  • he/she may request the restriction of the processing of personal data,
  • he/she may request the free transmission of personal data in a structured, commonly used and machine-readable format
  • he/she may lodge a complaint with a supervisory authority if he/she considers that the processing of personal data infringes the General Data Protection Regulation,
  • the data subject may lodge a request for the exercise of the rights referred to in the preceding paragraph or obtain further information concerning the processing and protection of personal data with authorized data protection person  at the following e-mail address: info@portoroz.si or at the address of the Turistično združenje Portorož, g.i.z., Obala 16, 6320 Portorož,
  • the individual may lodge a complaint with the Information Commissioner of the Republic of Slovenia regarding the processing of personal data which does not comply with these General Terms and Conditions of the prize contest.

ARTICLE 15: MODIFICATION OF TERMS AND CONDITIONS

The organiser of the prize contest - the Portorož Tourist Board, Obala 16, 6320 Portorož, reserves the right to change the Terms and Conditions of the prize contest at any time, if there are substantive, commercial or technical reasons for doing so.

The organiser will keep participants informed of any changes and updates with publications on the prize contest website.

ARTICLE 16: OTHER PROVISIONS

Employees of Turistično združenje Portorož, g.i.z. and their immediate family members, as well as other natural or legal persons who in any way are involved in the running of the prize contest, are not allowed to participate in this contest.

The Terms and Conditions are binding on the organiser, all employees and other persons in any way connected with this prize contest and the prize draw that are subject of these Terms and Conditions and on the participants in the prize contest who, by accepting these Terms and Conditions, agree to be bound by them.

ARTICLE 17: ACCESSIBILITY OF TERMS AND CONDITIONS

These Terms and Conditions are available on the website www.portoroz.si.

ARTICLE 18: COMPLAINTS AND CLAIMS

All complaints and claims relating to the prize contest shall be resolved by the organiser. In the event of justified complaints, the organiser undertakes to resolve them as soon as possible and to inform the participant or, where applicable, the other participants thereof.

Any disputes arising in connection with the prize contest and draw, will be resolved under the jurisdiction of the relevant court in Koper.

ARTICLE 19: FINAL PROVISIONS

The organiser undertakes to do everything in its power to ensure that the prize contest is run correctly and this liability does not include cases of force majeure. In the event of circumstances beyond the organiser's control (force majeure, logistical obstacles, technical problems), the organiser may terminate the prize draw. The organiser must inform the participants thereof. In such a case, the winners shall not be held liable for any damages incurred. The organiser's decision on all matters relating to the prize draw or the application of the Terms and Conditions shall be final and binding on all partecipants.

ARTICLE 20: VALIDITY OF TERMS AND CONDITIONS

These Terms and Conditions will come into force on 10 May 2022.
